Terms of Service

By accessing and using Skyflux's website and services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

These Terms of Service apply to all visitors, users and others who access or use our services. We reserve the right to update or modify these terms at any time without prior notice.

Skyflux operates as an affiliate publisher. Our activities include but are not limited to: operating content websites, managing paid creator placements, sending promotional email campaigns, running coupon and deals portals, and distributing affiliate content through social communities — all for the purpose of generating affiliate commissions from approved advertiser programs.

Skyflux earns revenue through affiliate commissions only. We do not charge advertisers fees for promotion. Any consultancy or service agreements with third parties are governed by separate written agreements.

Skyflux operates as a publisher and affiliate marketing agency in full compliance with the terms of service of all affiliate networks and programs we participate in. We do not engage in prohibited practices including but not limited to: cookie stuffing, forced clicks, incentivized traffic without authorization, brand keyword bidding without permission, or any form of affiliate fraud.

All promotional content produced by Skyflux includes proper affiliate/sponsored disclosure as required by the FTC, ASA and applicable regional regulations.

Advertisers and partners who engage with Skyflux agree to provide accurate information about their affiliate programs, including commission terms, promotional restrictions and brand guidelines. You are responsible for ensuring your affiliate program terms are clearly communicated and that Skyflux is notified of any changes to permitted promotional methods.

You agree not to use Skyflux's publisher services for any purpose that violates applicable laws or the terms of service of the affiliate networks through which we operate.

All content, features and functionality available through our services — including but not limited to information, software, text, displays, images, video and audio — is owned by Skyflux or its licensors and is protected by copyright, trademark, patent, trade secret and other intellectual property laws.

Work product created specifically for a client under a service agreement becomes the client's property upon full payment of all fees.

Skyflux earns commissions through affiliate network platforms. Payment terms are governed by the respective affiliate network's publisher payment schedule and policies. Skyflux does not invoice advertisers directly for publisher activities — all commission payments are processed through the applicable affiliate network.

For any separate service agreements (such as consultancy or managed services outside affiliate network relationships), payment terms are as specified in the individual written agreement. Invoices under such agreements are due within 30 days of issuance unless otherwise agreed in writing.

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of the business relationship. This obligation survives the termination of any service agreement.

Skyflux will not disclose client data, campaign performance or business information to third parties without written consent, except as required by law.

To the fullest extent permitted by applicable law, Skyflux shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising out of or in connection with these Terms or your use of our services.

Our total liability for any claims arising under these Terms shall not exceed the total fees paid by you for the relevant services in the six months preceding the claim.

Either party may terminate a service agreement with 30 days written notice unless a different notice period is specified in the agreement. Upon termination, all fees for services rendered through the termination date become immediately due and payable.

We reserve the right to terminate services immediately for material breach of these Terms or the applicable service agreement.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction as specified in the relevant service agreement.
